Terms of Use for Haiku

1. Acceptance of Terms

By downloading, installing, or using Haiku (the "App"), you agree to these Terms of Use. Haiku is operated by Panda Taps LLC ("Haiku," "we," "us"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, Panda Taps LLC grants you a personal, non-commercial, non-transferable, revocable license to use Haiku on Apple devices that you own or control, solely for your personal enjoyment of public-domain poetry. This license does not transfer ownership of any part of the App, its design, its code, or its compiled assets to you.

3. Subscriptions and Free Trials

Haiku Plus is offered through Apple In-App Purchase. By subscribing or purchasing, you agree to the following terms in addition to Apple's standard subscription terms:

• Yearly auto-renewable subscription at $9.99 per year, with a 7-day free trial for new subscribers.
• Monthly auto-renewable subscription at $1.99 per month, with a 7-day free trial for new subscribers.
• A one-time Lifetime non-consumable purchase is also offered (see in-app paywall for current price).
• If you do not cancel during the free trial, your subscription will renew automatically at the listed price.
• Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in iOS Settings → Apple ID → Subscriptions, or via the manage-subscription link inside the App's Settings tab.
• The Lifetime purchase is a one-time, non-refundable transaction (subject to Apple's refund policy) that grants access for the lifetime of the App's availability on the App Store. It has no recurring charges.
• Refunds for subscription charges and the Lifetime purchase are handled by Apple under Apple's refund policy. Panda Taps LLC does not directly process refunds.

4. Intellectual Property

• Poem text is in the public domain. The works of Shakespeare, Dickinson, Whitman, Frost, Rumi, and the other poets in the corpus are not owned by Panda Taps LLC; they are free for anyone to read, copy, and republish.
• Author biographies are adapted from Wikipedia and are used under the Creative Commons Attribution-ShareAlike 4.0 license (CC BY-SA 4.0). Attribution is preserved inside the App.
• Everything else in the App - the Haiku name, logo, typography choices, code, user interface, design system, curated collections, classifier logic, and editorial commentary - is the property of Panda Taps LLC and is protected by copyright and trademark law.

5. User Content

Haiku does not host user-generated content. Highlights, favorites, and notes you create inside the App stay local on your device and are never uploaded to a Panda Taps server. The App does not include comment threads, social feeds, or any feature that would publish your activity to other users.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the App's corpus, classifier, or other compiled assets for redistribution.
• Scrape the in-app poem corpus, author database, or curated collections by automated means.
• Resell, share, or otherwise transfer your Haiku Plus subscription or Lifetime entitlement to another person.
• Use the App, its corpus, or any other Haiku content to train, fine-tune, evaluate, or develop any machine learning model or large language model without our prior written consent.
• Use the App for any unlawful purpose or in any manner that materially interferes with its operation.

7. Disclaimer of Warranties

Haiku is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, Panda Taps LLC disclaims all warranties including, without limitation, merchantability, fitness for a particular purpose, accuracy or completeness of any poem text or author biography, correctness of any form classification, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the App is error-free, uninterrupted, or that any defect will be corrected.

8. Limitation of Liability

To the fullest extent permitted by law, Panda Taps LLC, its owners, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of property, data, business, or goodwill, arising out of or related to your use of the App.

Our total aggregate liability to you for any claim arising from your use of the App will not exceed the greater of (a) the total amount you actually paid to Panda Taps LLC through Apple In-App Purchase in the 12 months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

9. Termination

Either party may terminate at any time. You may terminate this license by uninstalling the App from your device; uninstalling the App terminates the license but does not, by itself, cancel any active subscription (use iOS Settings to cancel). We may suspend or terminate your access to subscription features if you violate these Terms. Termination does not waive any obligations that accrued before termination.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from or related to the App or these Terms will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. The App is offered solely for use where lawful; users in jurisdictions where any provision of these Terms is unenforceable agree to the maximum protection permitted by local law.

11. Changes to These Terms

We may update these Terms periodically. Material changes will be reflected on this page with a new Effective Date and will be surfaced inside the App's Settings. Continued use of the App after changes are posted signifies acceptance of the updated Terms.
